I don't know man, I know a few of the guys from D53 personally and they are all stand-up dudes. In fact I just played airsoft with Travis on Saturday. I wouldn't go putting them in the same boat with Evike until you get your issue resolved. It's easy to get mad when you have to return something or feel you made a bad purchase but if they said they tested the gun, they most-likely did.
