Question on ITAR..

Hi guys

 

I'm not too familiar with specifics of ITAR. All I know is that prohibits real steel parts from being exported from the US.

 

I live in HK, and I know quite a few ppl who have managed to source RS bits from the States. As I will be making a trip to the States soon, I wondered if the Magpul (not PTS) AFG2, XTM hand stop rail cover, and RVG are covered under ITAR?

 

I added these items to 'my cart' on Amazon and they won't ship it to HK :'( so my noob guess is that they do..

I do think that MAGPUL items are covered by ITAR. But ITAR in itself does not mean that they are strictly prohibited from export from the US. It simply means they are covered by certain rules and regulations.

 

You can purchase ITAR Items for export form the US if the order total, excluding shipping cost, is below $100 USD.

 

If the sum of you order is above $100 USD you will be required to file a DDTC export request for ITAR items. I think it was $300 USD charge or 3% of the order total, whichever comes first, and the processing time is about 3 months.

 

So my advice would be to order from somewhere likes Brownells and order items for under $100 USD at a time.

 

Also something worth noting is that, for an ITAR covered item to be allowed for export from the US, the actual manufacturer must also be registered with the DDTC, which is an annual cost for the company. Some smaller companies have not done this so while the items may technically be free for export under the above conditions, if they are not DDTC registered their products may not be exported.

 

MAGPUL howerver are DDTC registered.

I do not however know how it works if you are inside of the US and purchase these items on site and then take with you out. But I would assume that the same rules apply that if the total value of your iTAR items exceen the $100 USD you may get into trouble with customs etc.

 

I would advice you to look into this thuroughly before attempting to do this. I don't think you want to get caught with this stuff at an airport without the proper paperwork... :P

Magpul stuff is covered by ITAR, to my great dismay, and Magpul themselves refuse to send their accessories abroad for that very reason. Even if they're under $100, and the Mossberg M500 stock and grip very much are.

MAGPUL does not sell internationally directly because they don't want to handle the administration of the ITAR and DDTC paperwork.

 

If you buy from a retailer they will ship it to you if the order is under $100 USD or if you acquire the proper paperwork and pay the registration fee.

I shot an email to Brownells asking about whether they would ship the XTM handstop to me. Unfortunately they don't have the other magpul accessories I have my eye on. Would you have any other recommendations on reputable RS accessories retailers?

 

Also been thinking about purchasing them online and having them delivered to a US address, then when I am stateside I would ship them back to myself personally..

There's MidwayUSA as well, those are the ones I know of... But I think Brownells is one of the few US retailers who ship internationally without much fuss.

 

As for your shipping strategy, just think about that twice before you do it as you may be charged with weapons smuggling if you don't do it properly. Just want you to realize that.

 

US residents who wish to export any ITAR regulated item must register a DDTC export request for, even for a single item regardless of costs, or retail value. If you are a non US resident inside of the US and shipping it out, I don't know what the rules are really.

 

Just make sure you know what you are doing... :o

I think most of the info I got was from Brownells internal documents and them some from the DDTC / ITAR websites. Read up on it, the US do not *fruitcage* around with this stuff :P

Cheers to all who helped me out earlier. I have a different question now - I picked up a used 552 today and it needs some repairs. As I am in HK and the repairs will be covered by L3 warranty, I'm wondering if its possible to import the 552 to the US?

 

I've read through most of the links provided previously but didn't come across any import restrictions.. as I need to decide whether to keep it and send it in for repairs, or to return it to the seller for a refund, looking for a quick answer as I dont have enough time to sift through all the legal documents :D

I'm going to sound like an idiot, but...who's supposed to do the paperwork if I'm importing an item from the US?

 

Both the End User (You) and the Exporter need to obtain the appropriate agreements from each other's governments to ship- you have to request it (as ably described above)

Depends on the item and order amount.

 

Sub 100 USD orders usually require no extra paperwork unless there is a specificly restricted item in the order.

 

Otherwise (above 100 USD or specific items) you have to do the paperwork and send in to the retailer who in turn then do paperwork onwards to DDTC.
